DUI Arrest Videos

Taxpayers have invested in video and audio taping equipment for law enforcement use, but rarely are they used during a drunk driving arrest. What proof do you have, other than the officer stating you were drunk driving (based on his observations of you) and the results of an inaccurate field sobriety test. These recordings could document your performance during the roadside tests and provide firsthand evidence of whether you were driving under the influence or not. For example, the officer might ask you to recite the alphabet. Instead of the officer stating his opinion in his report while you attempt to do this, a recording of you reciting the alphabet is actual evidence of whether you were intoxicated or not. Video taping should be made available so that you are prepared to provide the jury with direct evidence of the truth.

It is unfortunate that the arresting officer may embellish what really happened during your arrest or simply may not have the skills to recognize the difference between legal and illegal levels of impairment. The officer's opinion is largely biased and may cause a situation of his word against yours in court. An anonymous California highway patrol officer has admitted that convicting a driver of DUI is a huge financial motivation for him. It is possible for an officer to double his salary in overtime by appearing in court for drunk driving cases, suggesting by about $50,000. This California highway patrol officer has also mentioned that although he may not believe a driver was intoxicated, his patrol partner would and would proceed with the arrest, for the potential overtime pay.

Although it is never recommended that you drink and drive no matter how much you've had to drink, drinking and driving does not mean you are breaking drunk driving laws. There are laws and guidelines that a licensed driver and those trained to uphold the law must abide by. For this and the reasons mentioned above, you should never surrender to any of the roadside breath tests and sobriety checkpoints. If you are ever called as a juror on a California DUI case, you should not accept the officer's testimony as pure evidence against an accused drunk driver. Request that video or audio tapings be provided for your review, or any other firsthand evidence of intoxication. These types of evidence are easy to present and should not be overlooked.
